Last Updated: December 18, 2025

These Terms of Service (“Terms”) are a legally binding agreement between you (“you,” “your,” or “User”) and PlainDivorce (“PlainDivorce,” “we,” “us,” or “our”), governing your access to and use of PlainDivorce.com and any related pages, content, tools, communications, and downloadable products (collectively, the “Website” and “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Changes to These Terms

We may supplement, remove, modify, or update these Terms at any time, from time to time, in our sole discretion. Changes are effective when posted on the Website, and we will update the “Last Updated” date above.

It is your responsibility to review these Terms periodically. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.

2) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Services or purchase any digital products. By using the Services, you represent and warrant that you meet this requirement.

3) What PlainDivorce Is (and Is Not)

PlainDivorce provides self-help informational resources and digital downloadable materials intended to help users understand general uncontested divorce processes and prepare paperwork.

PlainDivorce is not a law firm, does not provide legal advice, and does not provide legal representation. No attorney-client relationship is created by your use of the Services, your purchase of products, or any communications with us. If you need legal advice, you should consult a licensed attorney in your jurisdiction.

4) Use of the Website; “As-Is” Information

We provide the Website and Services for general information and self-help purposes, on an “as-is” and “as-available” basis.

  • You understand and agree that the Website and its content may change at any time without notice.
  • Laws, court forms, filing rules, fees, and timelines can change and may vary by location and case facts.
  • You are responsible for verifying current requirements directly with the applicable court or official government source before filing.

5) No Warranties

To the maximum extent permitted by law, PlainDivorce makes no warranties or representations, express or implied, regarding the Services, including (without limitation):

  • that the Website content is current, accurate, complete, or reliable;
  • that access will be uninterrupted, timely, secure, or error-free;
  • that any defects or errors will be corrected; or
  • that the Website, servers, downloads, or communications are free of viruses or other harmful components.

6) Purchases; Digital Products; Delivery

We offer digital products (for example, guides, checklists, templates, and informational materials) delivered electronically via download link, account access (if offered), email, or other digital means. Prices, product offerings, and delivery methods may change at any time.

7) Refunds; All Sales Final for Digital Goods

Because our products are digital and typically delivered immediately, all sales are final unless otherwise stated at checkout or required by applicable law.

We may, at our sole discretion, provide a refund in limited circumstances (for example, duplicate purchases or confirmed technical non-delivery after reasonable support troubleshooting).

8) License and Acceptable Use

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Website and use purchased digital products for your personal use in connection with your own matter (or your household’s matter).

You may not (unless we expressly permit in writing):

  • copy, reproduce, republish, upload, post, publicly display, transmit, resell, sublicense, rent, or distribute the products or Website content;
  • share files or download links with third parties;
  • create derivative works or competing products using our materials;
  • scrape, crawl, harvest, or use automated means to extract data or content from the Services;
  • attempt to bypass paywalls, access controls, license keys, download limits, or other security measures; or
  • use the Services in any unlawful, harmful, deceptive, or abusive manner.

We reserve the right to suspend or terminate access for violations.

9) Intellectual Property

The Website and all content, designs, text, graphics, templates, product structure, trademarks, logos, and compilations are owned by PlainDivorce or its licensors and are protected by applicable intellectual property laws.

Limited quotations or excerpts for non-commercial purposes may be permitted where lawful (for example, brief excerpts for review or commentary) provided you do not misrepresent the source and you include appropriate attribution. Any other use requires prior written consent.

10) Third-Party Websites and Links

The Website may contain links to third-party websites or resources not owned or controlled by PlainDivorce. We do not endorse, control, or assume responsibility for third-party websites, their availability, security, accuracy, or content.

Your use of third-party websites is at your own risk and is subject to their own terms and policies.

11) Privacy

Your privacy matters to us. Our collection, use, and handling of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. To the extent permitted by law, if there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls.

12) Cookies and Similar Technologies

We may collect certain information automatically when you visit the Website using cookies and similar technologies. This information may include IP address, device and browser type, operating system, approximate location (derived from IP), and browsing behavior on our Website.

We use this information for purposes such as site functionality and performance, analytics and statistical reporting, improving user experience, and fraud prevention and security. You can control cookies through your browser settings. Disabling certain cookies may affect Website functionality.

13) Limitation of Liability

To the maximum extent permitted by law, PlainDivorce and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) the Services.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the specific product or service giving rise to the claim in the twelve (12) months preceding the event. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14) Indemnification

You agree to defend, indemnify, and hold harmless PlainDivorce and its owners, officers, employees, contractors, agents, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of any law or third-party rights; or
  • your misuse or unauthorized distribution of any product or content.

15) Suspension and Termination

We may suspend or terminate your access to the Services (including access to downloads, accounts, or purchase history if applicable) at any time if we reasonably believe you have violated these Terms, attempted to misuse the Services, or engaged in unlawful or abusive conduct.

Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute provisions).

16) Governing Law; Venue

These Terms are governed by the laws of the jurisdiction determined to apply under applicable law, without regard to conflict of laws rules.

To the extent permitted by law, you agree that any legal action, claim, or proceeding arising out of or relating to the Services will be brought in a court of competent jurisdiction, and you consent to personal jurisdiction where required.

17) Notices; Contact

Questions about these Terms or the Services can be directed to: [email protected]

18) Miscellaneous

  • Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right or provision is not a waiver.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
  • Entire Agreement: These Terms, together with the Privacy Policy and any additional posted policies, constitute the entire agreement between you and PlainDivorce regarding the Services.
