Serve your spouse
Have your spouse formally served with the filed Complaint and Summons — personally, or (if they're off-island or out of state) by a court-approved method. If they agree, they later sign an Appearance and Waiver. If they don't respond within 20 days, you may proceed by default instead.
File financial & final documents
File your financial statements, then your Affidavit of Plaintiff and Proposed Decree. The judge typically reviews the file within six to ten weeks and may approve it without your appearance, or ask for more. The divorce is effective once the judge signs and the court file-stamps the Decree.

"What is 'Divorce by Affidavit' in Hawaii?"
It's a process where you submit sworn statements to the judge instead of appearing in court. In an uncontested case, you don't have to appear if the judge approves your forms — the judge may instead ask for additional sworn affidavits or set a hearing.
"What is the residency requirement?"
At least one spouse must have been domiciled or physically present in Hawaiʻi for a continuous 6 months before filing. Additionally, the filing spouse must have been domiciled or present in the filing circuit (e.g., First Circuit for Oʻahu) for at least 3 months.
"Do I need an Asset and Debt Statement?"
Generally, yes — both you and your spouse complete an Income and Expense Statement and an Asset and Debt Statement. Your spouse's copies aren't required if you're proceeding by default or if they refuse to provide them (you explain why in your Affidavit of Plaintiff), and you may instead file one joint Asset and Debt Statement signed by both of you.
"What if I have children?"
You can still use the "Divorce by Affidavit" process, but you'll need to include custody, visitation, and child support terms in your Decree, complete a Child Support Guidelines Worksheet, and finish the mandatory parent-education program — called Kids First on Oʻahu, Maui, and Kauaʻi, and Children First (Kona) or Children in Transition (Hilo) on Hawaiʻi Island. Attendance and excusal details are set by your circuit; confirm current requirements before filing.
"Do I have to appear in court?"
Not necessarily — but it isn't guaranteed either. If the judge is satisfied with your paperwork, they may approve your divorce without either spouse appearing. If not, the judge can require more sworn affidavits or set a hearing before deciding.
"Is $129 the total cost of my divorce?"
No — $129 is the one-time price of the kit itself. You'll also pay the Family Court's own filing fee directly (currently $215 without minor children, or $265 with minor children). Even with that added, it's typically far less than hiring a lawyer.
